The Innovative Design Protection and Piracy Prevention Act - A Friend or Faux to Fashion and Creativity?

The International Working Group on Global Organic Textile Standard (GOTS IWG) invites you to a seminar about the organic textile processing standard . The event is co-hosted by the Organic Trade Association (member of the IWG), Textile Exchange, and the law firm of Sheppard, Mullin, Richter & Hampton LLP. Attending will be representatives from along the apparel and textile chain including manufacturers and retailers.

As you may know, GOTS is the stringent voluntary global standard for the entire post-harvest processing stages (including spinning, knitting, weaving, dyeing and manufacturing) of apparel and home textiles made with organic fiber (such as organic cotton, organic linen, and organic wool), and includes both environmental and social provisions for post-farm to retail shelf management. Key provisions include a ban on the use of genetically modified organisms (GMOs), hazardous inputs (such as heavy metals and formaldehyde) and child labor, while requiring living wages and strict waste water treatment practices.

At the training, experts will provide an overview of the standard, case studies of companies certified to GOTS, and a walk-through of the process of getting your company certified. Getting GOTS certification enables your company to offer products to the ever more discerning “green” consumer that are organic from field to finished product and meet the new U.S. Department of Agriculture textile labeling policy which now explicitly permits use of the term “organic” for finished textile articles certified to GOTS.

We’ll start with organic refreshments then move on to the presentations, leaving ample time for an interactive Q+A session.

The seminar will be kicked off by Ted Max, co-leader of Sheppard Mullin’s Fashion, Apparel and Beauty Team. Speakers include:

Once regarded as the “cost of doing business,” the act of “greasing the palm” or giving money or gifts to someone to get favored treatment or something done may result in criminal liability under federal or state law. The Foreign Corrupt Practices Act (FCPA) is a federal law that prohibits individuals and businesses from bribing foreign government officials. New York and California commercial bribery law criminalizes the giving or receiving (or offering or soliciting) of “any benefit” without the consent of the receiver’s employer, with the intent of influencing the receiver’s business conduct.

If your company is doing business in New York, California or abroad, you should carefully examine whether you have effective policies and procedures in place to manage risks under these anti-bribery statutes. Careless behavior and allegations of bribery can subject your company to the risk of a law enforcement investigation, a public relations nightmare, and the potentially high cost of an internal and law enforcement investigation and possible prosecution in multiple jurisdictions under the FCPA and Commercial Bribery laws.

Counterfeiting costs the global economy more than $100 billion every year. "Second Life" is reported to support an economy of over $2 million U.S. in counterfeits per day and $1.3 million U.S. in total goods paid in Linden dollars per day. The Internet provides a faceless marketplace and many hidden alleys for trademark and copyright counterfeiters and infringers. As the urgent problems of online fraud, piracy, counterfeiting, infringement and brand abuse proliferate, brand owners need to be prepared to stop infringers and counterfeiters with more than just "cease and desist" letters. This seminar will discuss the global issues involved in protecting rights on the Internet.
